1.USER INFORMATION

Who is responsible for treating your personal data?
DOMIBAY S.L is the ADMINISTRATOR and will treat the USER’s personal data and informs them that this data will be treated in accordance with the provisions of the (EU) Regulations 2016/679, from 27th April (GDPR), and the Organic Law 3/2018, from 5th December (LOPDGDD).
What do we treat your personal data for, and why?
According to the manner in which we have obtained your personal data, we will treat it confidentially for the following purposes:

Contact form

To respond to any enquiries or requests made by users via any  of the contact forms available on the administrator’s website  (for the legitimate interest of the administrator, article 6.1.f GDPR). To send commercial and advertising communications via email, fax, SMS, MMS, social media, or any other electronic or physical means, either now or in the future, which allows for commercial communications to be sent. These communications will be made by the administrator and will be related to their products and services, or those of their collaborators and lenders, with whom a promotional agreement has been made. In this regard, third parties will never have access to any personal data (only with the consent of the interested party, 6.1.a GDPR).

Statistics analysis and market research.

To moderate and publish on the website any opinions about a post (with the consent of the interested party, 6.1.a GDPR).
In the user Registration form. To manage the user account to provide them with personalised access to the website and the interactive services it offers.

In the Terms and Conditions form. To manage your purchase or online order, to process the payment and to dispatch the order, based on the general contractual conditions.

To send commercial and advertising communications via email, fax, SMS, MMS, social media, or any other electronic or physical means, either now or in the future, to customers, in order to make commercial communications regarding products or services similar to those which are why the customer initially signed up (article

In the seller sign up form

To manage and process any kind of information request, including those to become a partner.
To keep partners informed of any of the actions that we are carrying out. Sharing of activities

In the Newsletter form

To send out informative bulletins, news, and online offers and promotions (with the consent of the interested party, 6.1.a GDPR).
How long do we keep your personal data for?
The data will not be kept for longer than it is needed in order to treat it, or if there are any legal limitations ruling that it must be held or when it is no longer necessary. The data will be removed in accordance with the corresponding security measures to guarantee the anonymity of the data and the total destruction thereof.
Who do we give you personal data to?
We do not provision to give any of your personal data to third parties, unless required to do so for the undertaking and execution of the treatment thereof, in which case it will be given to our service lenders if related to any communications they send. The ADMINISTRATOR has confidentiality contracts signed with these as well as with the party responsible for treating the data, as required by the existing privacy regulations.

What are your rights?

The USER’s rights are:
The right to withdraw your consent at any time.
The right of access to, rectification, portability, and removal of your data, and the limitation or opposition of its treatment.
The right to file a claim with the controlling authority (www.aepd.es) if you consider that the treatment of you data is not inline with the current regulations.

2.MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER

The USERS, through ticking the corresponding boxes and entering their data into the corresponding fields, freely and unequivocally accept that their data is required for the processing of their order by the lender, with the inclusion of any other data in the other fields purely voluntary. The USER guarantees that the personal data provided to the ADMINISTRATOR is true and is responsible for notifying of any change made thereto.
The ADMINISTRATOR informs that all of the data requested via the website is mandatory, as it is needed to provide an optimum USER experience. In the case of not all of the data being provided, it cannot be guaranteed that the information and services provided are completely adapted to the user’s needs.

3.SECURITY MEASURES

In accordance with the provisions of the existing regulations for the protection of personal data, the ADMINISTRATOR is in compliance with all of the provisions of the GDPR and LOPDGDD regulations for the treatment of the personal  data it is responsible for, and especially with the principles described in article 5 of the GDPR, meaning that the data is treated legally, loyally, and transparently in regard to the interested party, and suitability, pertinently, and within the necessary limits of the data treatment.

The ADMINISTRATOR guarantee that it has implemented all of the appropriate technical and organisational policies to apply the security measures established in the GDPR and the LOPDGDD in order to protect the rights and freedoms of USERS and has provided them with all the information needed to exercise these.
